This Privacy Policy explains what information I collect, why I collect it, how it is used and stored, and the rights you have over your personal information.

  • Information relating to your permission for photographs to be used for portfolio, website, advertising or social-media purposes
  • Technical information generated when you use this website, such as cookies, browser information or website analytics where applicable

I will only collect information that is reasonably necessary for the operation of my photography business and the services I provide.

3. Photographs and Personal Data

Photographs or video in which a person can be identified may constitute personal data.

Photographs may be captured, stored, edited, backed up and delivered where necessary to provide the photography service you or another client has requested.

This may include photographs of adults and children.

Photographs will not automatically be used for advertising, portfolio or social-media purposes simply because you have booked a photography session.

Where OB Photography relies on your permission to use identifiable photographs for promotional purposes, this will be requested separately, for example through a model release or photo-use permission form.

4. Children

My photography services may involve photographing children.

Where a child is involved in a private photography booking, I will normally deal with their parent, guardian or another responsible adult.

The person making the booking should ensure that they have the appropriate authority or permission for children included in the session to be photographed.

Information relating to children will only be processed where reasonably necessary for the photography service or where another lawful basis applies.

I take particular care when considering whether photographs of children should be used publicly for promotional purposes.

5. How I Collect Information

  • Through enquiry and booking forms
  • Through Pixieset or another client-management/gallery system
  • Through contracts and questionnaires
  • During a photography session
  • Through email, telephone, social media or other correspondence
  • From another person making a group, family, wedding or event booking
  • From an event organiser or venue where reasonably necessary to provide the contracted photography service

Where someone provides personal information about another person, they should ensure that they are entitled to provide that information.

6. Why I Use Your Information

I may process personal information for the following purposes:

Enquiries and bookings

To respond to enquiries, provide quotations, arrange sessions, prepare contracts and administer bookings.

The lawful basis will normally be taking steps at your request before entering into a contract or performing a contract with you.

Providing photography services

To plan, photograph, edit, manage and deliver your photography.

The lawful basis will normally be performance of a contract or, where appropriate, legitimate interests in providing photography services requested by a client or event organiser.

Galleries and image delivery

To create private galleries and provide photographs to clients.

The lawful basis will normally be performance of a contract.

Accounting and business records

To issue invoices, record payments, maintain financial records and meet tax or other legal requirements.

The lawful basis may be performance of a contract and/or compliance with a legal obligation.

Business administration and protection

I may retain appropriate records where necessary to manage the business, resolve complaints, establish what was agreed between us, prevent misuse of my work or establish, exercise or defend legal claims.

The lawful basis may be my legitimate interests in operating and protecting my business and legal rights.

Portfolio and advertising

My own promotional use of identifiable client photographs, including my portfolio, website, social media, advertising and competitions, requires separate, specific optional permission from the relevant individuals or an appropriately authorised parent or guardian. Booking or signing a photography contract does not give this permission. Refusing or withdrawing permission does not affect the service or price. You may withdraw consent at any time by contacting anthony@obphotography.uk. I will stop consent-based use and remove affected material under my control as soon as reasonably practicable.

Withdrawal of consent does not make previous lawful use of the information unlawful.

It may not always be possible to recall material that has already been lawfully printed, distributed or published by third parties before permission was withdrawn.

Marketing communications

I may use contact information to send marketing communications only where permitted by applicable law.

You may ask me to stop sending marketing communications at any time.

7. Legitimate Interests

Where I rely on legitimate interests, those interests may include:

  • Operating and administering OB Photography
  • Responding to enquiries
  • Delivering photography services
  • Protecting the security of my website, systems and images
  • Maintaining appropriate business records
  • Handling complaints and disputes
  • Protecting and enforcing my copyright and other legal rights

Where legitimate interests are used, I will consider whether those interests are outweighed by the rights and interests of the people concerned.

8. Who Your Information May Be Shared With

I do not sell your personal information.

Information may, where reasonably necessary, be processed or shared with trusted service providers used to operate OB Photography, such as:

  • Website hosting providers
  • Pixieset or other photography gallery and client-management services
  • Accounting and bookkeeping services such as QuickBooks
  • Email and cloud-storage providers
  • Payment-processing providers
  • IT or backup providers
  • Professional advisers such as accountants, insurers or legal advisers
  • Government, regulatory, law-enforcement or tax authorities where legally required

Service providers are given access only where reasonably necessary for the service they provide.

9. International Data Transfers

Some technology providers used by OB Photography may process or store information outside the United Kingdom.

Where personal information is transferred internationally, I will take reasonable steps to ensure that an appropriate lawful transfer mechanism or other protection required by UK data-protection law applies.

10. How Long I Keep Information

I do not keep personal information for longer than reasonably necessary for the purpose for which it was collected.

Retention periods depend on the type of information concerned.

For example:

  • Unsuccessful enquiries may be deleted when they are no longer reasonably required.
  • Booking information may be retained after a session where necessary for business records, complaints or legal claims.
  • Financial and tax records will be retained for the period required by applicable law.
  • Client photographs may be retained for a reasonable period for delivery, backup, archive and protection against accidental loss.
  • Unless a different period is expressly agreed in the booking schedule, online galleries are available for 90 calendar days from the date access to the delivered gallery is sent to the client. Edited files are archived for six calendar months from that same date. Exact gallery-expiry and archive-end dates are supplied with delivery. These periods do not require deletion of records retained on a separate lawful basis, such as necessary accounting or legal-claim records.
  • Photographs being lawfully used as part of my portfolio may be retained for as long as that use remains appropriate or until the relevant lawful basis no longer applies.

Backup copies may remain for a limited additional period before being overwritten or securely deleted.

11. Security

I take reasonable technical and organisational precautions to protect personal information against accidental loss, unauthorised access, disclosure, alteration or destruction.

However, no online service, cloud-storage system or method of electronic transmission can be guaranteed to be completely secure.

12. Your Data Protection Rights

Depending on the circumstances and lawful basis being used, you may have rights including the right to:

  • Ask what personal information I hold about you
  • Request a copy of your personal information
  • Ask for inaccurate information to be corrected
  • Ask for information to be deleted in certain circumstances
  • Ask for processing to be restricted in certain circumstances
  • Object to certain processing
  • Request transfer of certain information in a portable format where applicable
  • Withdraw consent where consent is the lawful basis being relied upon

Some rights are subject to legal exceptions and do not apply in every circumstance.

Your right to object

Where I process your personal information on the basis of legitimate interests, you have the right to object to that processing in certain circumstances.

These Terms & Conditions apply to the website and photography services provided by Anthony O’Brien trading as OB Photography.

They are intended to explain clearly how bookings, payments, cancellations, image delivery, copyright and other aspects of the service are handled.

References to “you”, “the Client” or “the Customer” mean the person making or paying for the booking.

2. Individual Booking Contracts

These general Terms & Conditions apply to photography services unless different terms have been expressly agreed in writing.

Certain services, particularly weddings and events, may also be subject to an individual photography contract.

The individual contract, booking confirmation, selected package and invoice should be read together with these Terms & Conditions.

If there is a direct conflict between these general terms and a specific written photography contract agreed between us, the specific contract will take precedence in relation to that booking.

3. Making a Booking

An enquiry alone does not reserve a date.

A booking becomes confirmed when the booking requirements communicated to you have been completed. Depending on the type of session, this may include:

  • Acceptance of a quotation or package
  • Completion of the booking information
  • Signing the relevant photography contract
  • Payment of any required booking payment or retainer

Until those requirements have been completed, the requested date may remain available to other clients.

4. Prices

The price applicable to your booking will be the price shown in your quotation, booking proposal, invoice or agreed photography package. The 2026 prices apply to sessions, weddings and events taking place on or before 31 December 2026. The 2027 prices apply to sessions, weddings and events taking place from 1 January 2027. Please select the booking package matching the year of your photography date, not the year you make the booking. Existing agreed bookings retain their agreed price; a later website price change does not alter them.

Travel within 20 miles of Penygroes is included. Only miles beyond the 20-mile allowance are charged at £0.75 per mile in both directions; a 25-mile one-way journey adds £7.50. Additional travel, parking, admission, permit fees, coverage, prints, albums or other extras must be disclosed and agreed before they are charged.

OB Photography will not add undisclosed compulsory charges after a booking has been agreed.

5. Payments and Retainers

Standard booking payments are £50 for Everyday and Full Story lifestyle sessions, full payment for the Ceremony wedding collection, and 25% for the Half Day or Full Day wedding collections. A signed digital contract and the required payment secure the date. All booking payments count towards the agreed total and are not automatically non-refundable. For Everyday and Full Story sessions, the remaining balance is due 7 calendar days before the session. For Half Day and Full Day weddings, the remaining balance is due 14 calendar days before the wedding. Standard online event bookings require full payment at booking; any bespoke event payment schedule is agreed before acceptance. Any different arrangement must be expressly agreed in writing.

For bookings requiring a retainer or advance payment, the amount and payment deadline will be clearly stated before the booking is confirmed.

Everyday and Full Story balances are due 7 calendar days before the session. Half Day and Full Day wedding balances are due 14 calendar days before the wedding. Ceremony is paid in full at booking. Any expressly agreed different deadline is recorded in the relevant contract or invoice before acceptance.

If a payment is overdue on a confirmed booking, I will give written notice and a reasonable opportunity to pay before suspending work or delivery. Any proposed cancellation will be clearly notified and any retained amount remains subject to the cancellation terms and applicable law.

6. Client Cancellation

If you need to cancel a booking, please notify OB Photography as soon as reasonably possible.

Where a client cancels, OB Photography may retain or charge an amount representing reasonable losses directly caused by the cancellation, including work already completed, costs already reasonably incurred and loss associated with reserving the date.

Any amount retained will be proportionate to the circumstances and will take account of costs saved or the ability to obtain replacement work.

Nothing in these terms gives OB Photography an automatic right to retain an excessive payment where doing so would be contrary to applicable consumer law.

Any more specific cancellation provisions contained in your individual photography contract will also apply, provided that they are consistent with your statutory rights.

7. Statutory Cancellation Rights

Where you are legally entitled to a cancellation or cooling-off period because a contract has been entered into online, by telephone or away from business premises, these Terms & Conditions do not remove those rights.

The standard General, Wedding and Events booking contracts provide consumers booking online, by telephone or away from business premises with a 14-day cancellation period even if a statutory exception might otherwise apply. It ends 14 days after the day the booking agreement becomes binding. Business bookings do not receive this contractual cooling-off period. Any longer statutory right remains unaffected. A clear cancellation statement is sufficient; the optional contract form is not compulsory.

If you specifically request that OB Photography begins providing services during a statutory cancellation period, you may be required to pay a reasonable amount for services already supplied before cancellation, where permitted by law.

Certain contracts or services may be subject to statutory exceptions.

Your statutory consumer rights are not affected.

8. Rescheduling

If you need to change the date of a session, please contact me as early as possible.

I will make reasonable efforts to accommodate a new date, subject to availability.

A request to reschedule does not automatically guarantee that the requested alternative date will be available.

A request to change date does not itself cancel the original booking. If no replacement date is agreed, the original booking remains unless cancelled. Any price change or additional cost must be explained and agreed before you commit; there is no automatic postponement penalty.

9. Weather

Outdoor photography is affected by weather conditions.

Cloud, wind or light rain will not necessarily result in a session being cancelled.

Where weather conditions make the session unsafe or are likely to prevent the agreed service from being reasonably provided, I may recommend changing the location, adjusting the session or rescheduling.

Where a weather-related change is necessary, I will work with you to find a reasonable alternative. For lifestyle sessions, if weather makes the agreed session unsafe or unsuitable and no reasonable alternative can be agreed, payments for services not supplied will be refunded within 14 days of cancellation. Weddings and events follow their agreed weather and serious-disruption clauses.

10. Illness, Emergency or Photographer Cancellation

If I am unable to attend because of serious illness, injury, emergency or another circumstance beyond my reasonable control, I will contact you as soon as reasonably possible.

Anthony O’Brien personally provides the photography. No replacement or second photographer is provided under the standard booking contracts. Depending on the circumstances, I may offer:

  • A replacement date
  • A refund of amounts paid for photography services that cannot be provided

If I cannot supply the agreed service, you are not required to accept another date or substitute service. Payments for unprovided services and products will be refunded within 14 days of cancellation or confirmation that the coverage cannot be supplied, as applicable under your contract. Any deduction for separately priced work already supplied must be fairly and lawfully due and explained in writing. Other legal remedies remain unaffected.

11. Lateness

Please arrive at the agreed time for your session.

If you arrive late, I cannot guarantee that the session can be extended beyond the scheduled finishing time, particularly where I have another commitment afterwards.

If I am responsible for a significant delay, I will make reasonable efforts to provide the agreed coverage time or another appropriate solution.

12. Failure to Attend

If you do not attend an agreed session and have not contacted me, the booking may be treated as a client cancellation.

Any amount retained or charged as a result will be subject to the cancellation provisions above and applicable consumer law.

13. Photography Style and Creative Discretion

By booking OB Photography, you acknowledge that photography involves creative judgement.

My portfolio demonstrates the general style and approach you can expect, but individual photographs cannot be guaranteed to exactly reproduce images from another session or photographer.

Factors including weather, available light, venue restrictions, subject cooperation, timing and circumstances on the day can affect the final result.

I retain reasonable artistic discretion over matters including:

  • Composition
  • Exposure
  • Cropping
  • Colour treatment
  • Black-and-white conversion
  • Image selection
  • Retouching
  • Overall editing style

14. Image Selection

Not every photograph taken during a session will be delivered.

Images may be excluded for reasons including:

  • Duplicates
  • Test shots
  • Missed focus
  • Blinking or unsuitable expressions
  • Technical failures
  • Unflattering intermediate moments
  • Images that do not meet my professional quality standard

The number of photographs included with your package will be stated in the package description, quotation or individual contract.

Where a minimum number of photographs is advertised, I may deliver more at my discretion.

15. RAW and Unedited Files

RAW files, test photographs and unfinished images are working materials and are not included unless expressly agreed in writing.

Final edited photographs are the finished product supplied by OB Photography.

16. Editing and Retouching

Standard professional editing is included where stated in the selected package.

This may include adjustments to exposure, colour, contrast, cropping and general image finishing.

Extensive manipulation or specialist retouching beyond the normal scope of the package may incur an additional charge, which will be agreed before additional work is undertaken.

17. Delivery

Photographs will normally be delivered through a private online gallery or another method agreed with the client.

Standard delivery periods are: Everyday selection galleries within two weeks of the session, followed by finished selected photographs within 7 calendar days of receiving your selection; Full Story galleries within two weeks of the session; event galleries within three weeks of the event; and wedding galleries within six weeks of the wedding.

Any expressly agreed variation, selection deadline or product-production timetable must be recorded in the booking schedule before acceptance.

If an unexpected delay occurs, I will explain it promptly and agree a reasonable revised date without removing your legal remedies.

18. Gallery Downloads and Backups

Clients are responsible for downloading and safely backing up their photographs before an online gallery expires.

Unless a different period is expressly agreed in the booking schedule, gallery access lasts 90 calendar days from the date access to the delivered gallery is sent to you. Edited files are archived for six calendar months from that same date, not six months after gallery expiry. The archive does not extend online access. Gallery availability should not be treated as permanent cloud storage.

Where reasonably possible, I may retain additional backups for a period after delivery, but I cannot guarantee permanent storage of every completed gallery unless this has specifically been agreed.

19. Copyright

Unless otherwise expressly agreed in writing, copyright in photographs created by OB Photography remains with Anthony O’Brien / OB Photography.

Purchasing a photography service or receiving digital photographs does not transfer copyright ownership to the client.

Clients receive a licence to use the delivered photographs for normal personal purposes.

This normally includes:

  • Downloading and storing the photographs
  • Making personal prints
  • Sharing photographs with friends and family
  • Posting photographs to personal social-media accounts

Copyright notices or watermarks must not be deliberately removed where they have been supplied as part of a particular published or preview image.

20. Commercial and Third-Party Use

The client's personal-use licence does not automatically give businesses, publications, venues, suppliers or other third parties permission to commercially reproduce the photographs.

Photographs must not be sold, licensed, used in paid advertising, commercially published or supplied for editorial/commercial use without permission from OB Photography where an additional licence is required.

For weddings and events, suppliers or venues wishing to use photographs for their own advertising should contact OB Photography for permission rather than assuming that the client's personal licence extends to them.

21. Client Use and Alteration

Clients may crop photographs as reasonably necessary for personal social-media use.

However, photographs should not be materially altered, heavily filtered, manipulated or presented in a way that falsely represents the finished work of OB Photography.

This restriction does not prevent normal personal use of the delivered photographs.

22. OB Photography's Use of Client Images

Booking a photography service does not automatically mean that you agree to your identifiable photographs being used in my portfolio or advertising.

Separate, specific optional permission is required from the relevant individuals or an appropriately authorised parent or guardian. A booking client or event organiser cannot give permission on behalf of every guest. Each individual may withdraw their own consent at any time by contacting anthony@obphotography.uk. I will stop consent-based use and remove affected material under my control as soon as reasonably practicable. Earlier lawful use is unaffected; material already lawfully distributed or independently copied by others may not be fully recallable.

This may cover uses such as:

  • My website
  • Photography portfolio
  • Social media
  • Printed promotional materials
  • Photography competitions or professional portfolio assessment, where specifically stated

You may decline marketing or portfolio use without affecting the photography service you receive.

Further information is available in the OB Photography Privacy Policy and any separate photo-use permission or model-release form.

23. Events and Guests

For weddings, parties, business events and other gatherings, the client or event organiser should make reasonable efforts to ensure that attendees are aware that photography will be taking place where appropriate.

I will make reasonable efforts to respect genuine requests not to photograph a particular person where I am made aware of them and it is practical to do so.

24. Venue Rules and Permissions

The client is responsible for informing me of known photography restrictions imposed by a venue, officiant, event organiser or property owner.

I will comply with reasonable venue rules and lawful instructions.

OB Photography cannot guarantee photographs that cannot be taken because of restrictions outside my reasonable control.

25. Cooperation

The quality and quantity of photographs produced can depend on reasonable cooperation from the client and other participants.

While I will guide and assist where appropriate, I cannot guarantee particular photographs where circumstances outside my reasonable control prevent them from being created.

For weddings and events, reasonable delays to schedules may affect the coverage that can be achieved during the booked period.

26. Safety and Behaviour

I will not be required to work in conditions that I reasonably consider unsafe or where I am subjected to threatening, abusive or seriously inappropriate behaviour.

Where reasonably possible, an opportunity will be given to resolve the situation before photography is stopped.

If photography cannot safely continue because of circumstances caused by the client or their guests, this may be treated in accordance with the cancellation provisions of the booking.

27. Equipment Failure and Data Loss

I use reasonable professional care when capturing, storing and processing photographs.

However, photography involves electronic equipment and digital storage, and unforeseen failures can occur.

If photographs are materially lost or damaged because of circumstances affecting the service, I will work with the client to provide an appropriate remedy taking account of the circumstances and applicable consumer law.

Nothing in these Terms & Conditions excludes or restricts liability where doing so would be unlawful.

28. Circumstances Beyond Reasonable Control

Neither party will be considered at fault for a failure caused solely by circumstances genuinely outside their reasonable control, where reasonable steps have been taken to minimise the effect.

Examples may include severe weather, venue closure, serious transport disruption, emergency, natural disaster or government restriction.

Where this prevents the photography service from taking place, the parties will first try to agree a reasonable alternative such as rescheduling.

29. Consumer Rights

Photography services will be provided with reasonable care and skill.

Nothing in these Terms & Conditions limits the client's statutory rights under applicable UK consumer law.

If any term is found to be unlawful or unenforceable, the remaining terms will continue to apply where legally possible.

30. Complaints

If you are unhappy with any aspect of the service, please contact me as soon as reasonably possible so that I have an opportunity to investigate and resolve the issue.

Please provide your name, booking date and a description of the issue.

I reply to enquiries and acknowledge complaints within 2 working days. I aim to provide a substantive complaint response within 14 calendar days; if more time is needed, I will explain why and give a revised date. Working days exclude weekends and public holidays in England and Wales.
